Family

Spouse / Civil Partner Visas

This route allows British citizens and settled persons living in the UK to bring spouses or civil partners from outside the UK or EEA area to live and work in the UK.

This route has several strict requirements that must be met before an applicant qualifies. This route also covers dependent children of a British Citizen or settled person and adult dependent of a British Citizen.

Once the application is approved, the initial visa is granted for 2.5 years, after which you may apply for a Spouse Visa Extension for another 2.5 years. After five years, you may be able to apply for Indefinite Leave to Remain.

Unmarried Partner Visa

This route allows British citizens and settled persons living in the UK to bring unmarried partners from outside the UK or EEA area to live and work in the UK.

Unmarried partners must have been cohabiting together and been in a relationship akin to marriage for at least 2 years. We know that being close to loved ones is important. Once the application is approved, the initial visa is granted for 2.5 years, after which you may apply for an extension for another 2.5 years. After five years, you may be able to apply for Indefinite Leave to Remain.

Dependant

Dependant Visas

Dependant visas cover a range of visas. These include; children, adult dependants of British Citizens or settled persons and dependants of a point-based migrants.

A non-EEA dependent child of a British Citizen or a person with settled status can enter and remain in the UK using a Dependent Child Visa UK. As long as the child is eligible for a Dependent Child Visa, they will be granted Indefinite Leave to Remain (ILR) in the UK. The child can usually apply for British Naturalisation once they have lived in the UK for a continuous period of five years.

Also, a parent, grandparent, sibling or adult child of a British Citizen or a person with settled status in the UK, can apply for permission to reside in the UK on an Adult Dependent Visa in exceptional circumstances. These circumstances may apply when you are in need of long-term personal care, which your UK relative can provide. If this proves to be the case, you may be eligible to apply for an Adult Dependent Visa UK.

Finally, the dependant of a points-based system migrant can also join the PBS visa holder in the UK. The PBS Dependant visa is for partners and children of points-based system migrants to enter and remain the UK with their family member. To apply in this category, an applicant must be related to a PBS migrant as their husband, wife, civil partner, unmarried partner, same sex partner or child under the age of 18 at the time of application.

Fiancé Visa

A fiancé visa can be used by the partner of a British citizen or person with settled status to enter the UK to get married. To meet the fiancé visa requirements, the UK sponsor and the applicant must intend to be married within 6 months. They must live together permanently once they have been married. They must have physically met each other (Skype does not count).

The applicants must be able to support themselves or be supported by their partner, without access to public funds. Both parties must also pass the ‘genuine relationship test’ to be eligible.

EU, EEA, Swiss nationals and Family Members

All EU, EEA, and Swiss nationals who were resident in the UK on 31 December 2020 and wish to continue living in the UK must apply under the EU Settlement Scheme by 30 June 2021. If you do not apply under the EU Settlement Scheme and wish to continue living in the UK after June 2021, you will need to apply under a different route. The type of status you are eligible for, will depend on how long you have lived in the UK for.

You must apply if you were born in the UK but are not a British citizen or if you have a permanent residence document, or you are a family member of an EU, EEA or Swiss national. Other classes of people may be eligible to apply under the Scheme. These include: former family members of EU, EEA or Swiss nationals living in the UK, family members of British citizen but lived together outside the UK in an EEA country, children of EU, EEA or swiss nationals who used to live and work in the UK.
